Am I liable if a child is injured after the parent signs out for the day?

Potentially, yes. A provider wants to allow children and their parents access to her swimming pool during child care hours. She asks, "Will I be held liable if a child is injured after her parent signs out for the day, while I continues to provide care for other children?”

Once a parent signs out of your program, it is assumed that the child is no longer under the care of the provider. However, as long as the parent or child remain on the provider's property there is the risk of injury. Therefore, providers should be vigilant in enforcing their safety rules and do everything they can to keep the child safe. If a child is injured, the provider could be held liable for failing to do everything she could to keep the child safe.

Therefore, do no assume that you will not be held responsible for any injury suffered by a child after the parent signs out for the day.
